Terms of Service
Effective date:
1. General provisions
1.1. These Terms of Service (the “Terms”) govern the relationship between Individual Entrepreneur Ivanytskyi Roman Rizvanovych (RNOKPP 3012411355, registered address: 10 Ushakova St., Apt. 138, Kyiv, 03179, Ukraine), operating under the trademark BigDaySpace (the “Company,” “we”), the owner of bigday.space (the “Service”), and any individual who uses the Service (the “User,” “you”).
1.2. These Terms constitute a public offer within the meaning of Articles 633 and 641 of the Civil Code of Ukraine. Registering an account, or any other use of the Service, constitutes full and unconditional acceptance of these Terms.
1.3. If you do not agree with any provision of these Terms, please do not use the Service.
2. Definitions
- “Service” — the BigDaySpace web application (bigday.space), which allows creating and managing event pages.
- “Organizer” — a User who has registered an account and creates an Event Page.
- “Guest” — a person whose data is entered by the Organizer, or who confirms attendance (RSVP) without registering an account.
- “Event Page” — a personal web page created by an Organizer within the Service.
- “Coins” — the Service’s internal unit of account, granting access to paid features.
- “Plan” — the set of features an Organizer has selected (the free plan, or paid events purchased with Coins).
3. Description of the Service
3.1. The Service provides Organizers with tools to: create a personal event page, manage an event schedule, manage a guest list, collect RSVPs without requiring the Guest to register, display an interactive location map (integrated with Google Maps and Apple Maps), maintain a gift wishlist, and export data as CSV or sync it with Google Sheets.
3.2. The Company reserves the right to modify, extend, or discontinue individual features of the Service, notifying Users on the site or at the email address provided at registration at least 7 calendar days before making material changes, unless the law requires otherwise.
4. Registration and account
4.1. Using Organizer features requires registration with an email address or a phone number.
4.2. The User warrants that the information provided at registration is accurate and undertakes to keep it up to date.
4.3. The Service may be used as an Organizer by persons who are at least 18 years old, or who have obtained the consent of a legal representative in accordance with Ukrainian law.
4.4. The User is solely responsible for keeping account credentials confidential and for all actions performed under their account.
4.5. Guests may confirm attendance without registering an account; the scope of Guest data processed is limited to information necessary for RSVP (name, optionally a plus-one’s name, attendance status).
5. Plans and payment
5.1. The free plan allows creating up to three (3) events with basic functionality.
5.2. Creating events beyond the free limit, and other paid features of the Service, are available in exchange for Coins. Creating one event beyond the free limit costs 30 (thirty) Coins.
5.3. As of the effective date, the following Coin packages are available: 30 Coins — UAH 135 (one hundred thirty-five hryvnias); 100 Coins — UAH 446 (four hundred forty-six hryvnias). Prices are final; VAT does not apply (the Company operates under the simplified taxation system, single tax group 3).
5.4. Payments are processed via the WayForPay payment system, in accordance with the PCI DSS standard; the Company does not receive or store Users’ full card details.
5.5. The Company reserves the right to change prices. A price change does not apply to payments already made.
5.6. Refunds are governed by a separate document — the Refund Policy.
6. Rights and obligations of the parties
6.1. The User undertakes not to: use the Service for unlawful purposes; enter Guest data without a lawful basis (see Section 8); attempt unauthorized access; or upload materials that infringe third-party rights or are offensive, discriminatory, or unlawful.
6.2. The Company may suspend or terminate access for breach of these Terms, without prior notice in cases of serious violation.
6.3. The Company uses reasonable efforts to keep the Service running but does not guarantee error-free or uninterrupted operation.
7. Content and intellectual property
7.1. All rights to the Service (design, source code, the BigDaySpace trademark, databases) belong to the Company or are used by it on a lawful basis.
7.2. Content uploaded by an Organizer remains their property. By uploading content, the Organizer grants the Company a non-exclusive, royalty-free license to store, reproduce, and display it solely to provide the Service.
7.3. The Organizer warrants they hold all necessary rights to uploaded content and releases the Company from liability for related third-party claims.
8. Guest data
8.1. An Organizer who enters Guests’ personal data acts as an independent controller of that data and must have a lawful basis for collecting and transferring it, including informing the Guest that an Event Page has been created.
8.2. The Company processes Guest data on behalf of, and under the instructions of, the Organizer solely to provide the Service’s functionality, in accordance with the Privacy Policy.
9. Limitation of liability
9.1. The Service is provided “as is.” The Company does not warrant it will meet all expectations or operate without errors.
9.2. The Company is not liable for: acts of Guests; inaccurate User data; unavailability caused by factors beyond its control; or acts of third-party providers (WayForPay, Twilio, AWS) beyond its control.
9.3. Total liability is limited to the amount paid by the User in the 3 months preceding the claim.
10. Termination. Account deletion
10.1. A User may delete their account via Service settings or by contacting bigdayspace@gmail.com.
10.2. Data is retained for 30 days after deletion, then permanently deleted, except where retention is required by law (e.g., payment records).
10.3. The Company may terminate access for breach of these Terms.
11. Changes to these Terms
11.1. The Company may amend these Terms. Continued use after changes constitutes acceptance.
12. Force majeure
12.1. Neither party is liable for failure to perform caused by circumstances of insurmountable force (martial law, natural disasters, government acts, network failures, and similar events).
13. Governing law and dispute resolution
13.1. These Terms are governed by the laws of Ukraine.
13.2. Disputes are resolved through negotiation, and failing agreement, in the courts of Ukraine.
